Terms of Service

These Terms of Service govern your access to and use of the ScrapeGraphAI website, dashboard, APIs, SDKs, documentation, integrations, and related services provided by ScrapeGraphAI, Inc. By creating an account, using an API key, accessing the dashboard, or otherwise using the service, you agree to these terms.

1. Who May Use the Service

You may use ScrapeGraphAI only if you can form a binding contract and if your use is lawful in the places where you and your users operate. If you use the service for a company, organization, or other legal entity, you represent that you have authority to bind that entity to these terms.

You are responsible for the accuracy of the information you provide to us and for keeping your account credentials, API keys, and workspace access secure. Activity under your account is your responsibility unless it results from our failure to protect the service.

2. What ScrapeGraphAI Provides

ScrapeGraphAI provides web data extraction and automation tools that can fetch webpages, transform webpage content, generate structured outputs, crawl websites, monitor changes, and expose those capabilities through APIs, SDKs, dashboard workflows, and integrations.

The service helps you process web content, but it does not give you ownership of third-party websites, data, or content. You are responsible for deciding whether you may lawfully access, scrape, process, store, display, or use any target website or target content.

3. Customer Data, Target Content, and Outputs

Customer Data means prompts, URLs, schemas, files, credentials, configuration, account information, and other material you submit to the service. Target Content means content retrieved from websites, APIs, or other third-party sources at your direction. Outputs means summaries, extracted fields, screenshots, markdown, JSON, links, images, or other results generated by the service.

As between you and ScrapeGraphAI, you retain your rights in Customer Data. We do not claim ownership of your Customer Data or Outputs. You grant us the rights needed to host, process, transmit, display, troubleshoot, secure, and improve the service, and to provide support.

Outputs may be incomplete, inaccurate, delayed, or based on third-party content that changes without notice. You are responsible for reviewing Outputs before relying on them, publishing them, or using them in business, legal, financial, medical, employment, housing, credit, insurance, or other regulated decisions.

4. Your Responsibility for Websites and Data

You must have all rights, permissions, notices, consents, and legal bases required for the websites, URLs, data, and instructions you submit to the service. This includes responsibility for complying with applicable laws, third-party website terms, robots.txt and other machine-readable restrictions where applicable, intellectual-property rights, privacy rights, contract restrictions, and platform rules.

You may not use ScrapeGraphAI to access or extract content from websites or systems where automated access is prohibited, where you lack authorization, or where your use would violate law or third-party rights. ScrapeGraphAI does not provide legal advice about whether a particular scraping, crawling, monitoring, or extraction activity is permitted.

5. Acceptable Use

You may use the service only for lawful, authorized, and responsible purposes. You may not, and may not allow anyone else to:

  • use the service to violate any law, regulation, court order, contract, third-party terms, privacy right, intellectual-property right, or other legal obligation;
  • bypass or attempt to bypass logins, paywalls, CAPTCHAs, rate limits, robots restrictions, access controls, anti-bot systems, or technical measures without authorization;
  • collect, infer, process, or store personal data, sensitive personal data, health data, biometric data, children's data, payment data, or government identifiers without a lawful basis and all required notices and consents;
  • perform credential stuffing, account takeover, card testing, spam, phishing, malware distribution, vulnerability scanning, denial-of-service activity, or other abusive or security-harmful activity;
  • scrape or process content to create illegal discrimination, unlawful surveillance, deceptive profiling, or decisions that require human review or regulated compliance controls;
  • overload, disrupt, damage, or degrade ScrapeGraphAI, a target website, a third-party service, or the experience of other users;
  • resell, sublicense, or provide the service to third parties in a way that hides or misrepresents your responsibility for their use;
  • use the service to develop a competing service by copying our APIs, systems, documentation, or user experience, except to the extent applicable law prohibits this restriction.

6. API Access, Rate Limits, and Security

API keys are confidential. You must not share them publicly, embed them in client-side code, or allow unauthorized users to access them. If you believe a key or account has been compromised, you must rotate the key or contact us promptly.

We may apply usage limits, rate limits, concurrency limits, abuse controls, and other safeguards. We may throttle, reject, delay, or block requests that exceed your plan, harm service reliability, create legal or security risk, or appear abusive.

You may not interfere with the service, probe non-public systems, reverse engineer the service except where allowed by law, remove proprietary notices, or use undocumented endpoints except with our written permission.

7. Credits, Billing, and Taxes

Paid plans, subscriptions, usage-based charges, credit packs, renewals, and other commercial terms are described at checkout, in the dashboard, on our pricing page, or in a separate written order form. You authorize us and our payment processors to charge the payment method you provide for applicable fees and taxes.

Credits are non-refundable unless required by law or expressly stated in a separate written agreement. Credits expire according to your plan terms, and unused credits do not carry over between billing cycles unless we say otherwise in writing.

We may change prices, plan limits, included credits, and billing mechanics with reasonable notice. Changes do not affect charges already incurred, but they may apply to renewals, future billing periods, or future purchases.

8. Privacy and Personal Data

Our Privacy Policy explains how we collect and use personal information relating to accounts, billing, product analytics, support, and marketing. If you submit personal data or instruct us to process personal data through the service, you are responsible for having a lawful basis and providing required notices and choices.

You must not submit personal data or sensitive data to the service unless you are legally permitted to do so and your use of that data complies with these terms. If you need a data processing agreement, enterprise privacy terms, or subprocessor details, contact us before using the service for regulated personal-data workflows.

9. Free Plan Research and Model Improvement

Free Plan Data means Customer Data, Target Content, Outputs, usage logs, feedback, and related metadata generated through a free plan, free trial, promotional credit, sandbox, demo, or other no-charge access to the service. Free Plan Data does not include payment card details, passwords, secret API key values, or support communications unrelated to product use.

If you use the service through a free plan or other no-charge access, you agree that ScrapeGraphAI may use Free Plan Data for scientific research, product research, model evaluation, model training, model fine-tuning, benchmark development, safety improvement, abuse detection, quality improvement, and service improvement.

This research and model-improvement use is a condition of free access. The opt-out from this use is to stop using the free plan and use a paid tier or a separately agreed enterprise plan. We do not use data generated through paid tiers, Team plans, Enterprise plans, or paid API usage for model training unless you separately agree or opt in.

You must not use a free plan to submit confidential information, trade secrets, regulated personal data, sensitive personal data, or third-party data that you do not have the right to provide for research and model-improvement use.

10. Intellectual Property and Feedback

ScrapeGraphAI and its licensors own the service, including software, APIs, workflows, models, interfaces, documentation, templates, designs, trademarks, and other technology. Except for the limited right to use the service under these terms, we do not grant you any ownership or license in our technology.

If you provide feedback, suggestions, requests, or ideas, you allow us to use them without restriction or compensation. We will not treat feedback as confidential unless we separately agree in writing.

11. Third-Party Services and Content

The service may depend on or connect to third-party websites, AI providers, infrastructure providers, payment processors, integrations, open-source software, and external APIs. We do not control third-party services or target websites, and we are not responsible for their content, availability, terms, policies, or security.

Your use of third-party services may be subject to separate terms. You are responsible for complying with those terms when you connect integrations, submit URLs, access target websites, or use third-party content through ScrapeGraphAI.

12. Service Changes and Availability

We may modify, suspend, or discontinue features, plans, integrations, endpoints, models, or documentation. Where a change materially reduces paid functionality, we will use reasonable efforts to give advance notice unless urgent legal, security, reliability, or third-party-provider issues require faster action.

The service is provided on an "as is" and "as available" basis. We do not guarantee that the service will be uninterrupted, error-free, secure, or compatible with every website, data format, browser, framework, or integration.

13. Suspension and Termination

You may stop using the service at any time. We may suspend or terminate your account, API keys, or access to the service if you violate these terms, create legal or security risk, fail to pay fees, exceed usage limits, misuse the service, or if continued access would harm ScrapeGraphAI, users, third parties, or target websites.

Upon termination, your right to use the service ends immediately. Terms that by their nature should survive termination will survive, including payment obligations, ownership provisions, disclaimers, limitations of liability, indemnity, dispute terms, and restrictions on misuse.

14. Disclaimers

To the fullest extent permitted by law, ScrapeGraphAI disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and compliance with third-party website terms.

We do not warrant that any target website may lawfully be scraped, that Outputs will be accurate or complete, that target websites will not block requests, or that use of the service will satisfy your legal, compliance, security, or business requirements.

15. Limitation of Liability

To the fullest extent permitted by law, ScrapeGraphAI will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, reputational harm, third-party claims, or the cost of substitute services.

To the fullest extent permitted by law, ScrapeGraphAI's total liability arising out of or relating to the service or these terms will not exceed the greater of the amount you paid to ScrapeGraphAI for the service in the three months before the event giving rise to the claim or one hundred U.S. dollars.

16. Indemnification

You will defend, indemnify, and hold harmless ScrapeGraphAI, Inc. and its officers, directors, employees, contractors, affiliates, and agents from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or relating to your Customer Data, target websites, Target Content, Outputs, use of the service, violation of these terms, violation of law, or violation of third-party rights.

17. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will use reasonable efforts to notify you by posting the updated terms, updating the last-updated date, sending notice, or showing an in-product notice. Your continued use of the service after updated terms become effective means you accept the updated terms.

18. Governing Law and Disputes

These terms are governed by the laws of the jurisdiction where ScrapeGraphAI, Inc. is established, without regard to conflict-of-law rules. Any dispute arising out of or relating to these terms or the service will be resolved in the courts of that jurisdiction, unless applicable law requires a different forum.

Before filing a claim, you and ScrapeGraphAI agree to try to resolve the dispute informally by contacting support@scrapegraphai.com with a description of the issue, the relief requested, and enough information for the other party to evaluate the matter.
